These Terms & Conditions (“Terms”) govern the use of the website, software, and services provided by Mod Solutions d.o.o. (“Company”, “we”, “us”, or “our”). By accessing our website, purchasing software, uploading files, or using our services, you agree to these Terms.

2. Scope of Services and Software

The Company provides digital automotive products and services, including but not limited to:

  • ECU data file analysis and modification

  • ECU tuning and calibration files

  • Automotive-related software (desktop, cloud, or downloadable)

  • Digital tools, utilities, and licenses

All products and services are delivered digitally.
No physical goods are sold.

The English version of this website shall prevail.
Any translations into other languages are provided for informational purposes only. In the event of any inconsistency, the English version shall be considered authoritative.

3. Intended Use & Legal Compliance

Unless explicitly agreed otherwise in writing:

  • ECU tuning files and automotive software are intended for off-road, motorsport, testing, research, or export use only

The user is solely responsible for ensuring compliance with:

  • local traffic and vehicle regulations

  • emissions and homologation laws

  • software usage laws in their jurisdiction

The Company does not guarantee road legality or regulatory approval.

4. Software License & Restrictions

When purchasing or downloading software, the user is granted a:

  • non-exclusive

  • non-transferable

  • revocable

  • limited license

to use the software solely for its intended purpose.

The user may not:

  • reverse engineer, decompile, or modify the software

  • resell, sublicense, or distribute the software

  • use the software for illegal or unauthorized purposes

Ownership of the software remains with the Company.

5. User Obligations

By using our services or software, the user confirms that:

  • they have the legal right to use the vehicle, ECU, or system involved

  • uploaded files are owned or legally authorized

  • they understand the risks associated with ECU tuning and software use

  • appropriate backups are made before use

The user assumes full responsibility for implementation and usage.

6. File Uploads

Uploaded ECU files are processed confidentially.
Files are used solely to provide the requested service.

The Company is not responsible for issues caused by:

  • incorrect or incomplete uploads

  • corrupted files

  • wrong ECU identification

  • improper flashing or software use

7. Prices and Payments

All prices are shown in EUR, unless stated otherwise.

Payments are processed via:

  • PayPal

  • Credit card payments via PayPal

Payment must be completed before delivery of services or software access.

8. Digital Services, Software & No Right of Withdrawal

In accordance with EU Directive 2011/83/EU, the right of withdrawal does not apply to:

  • digital services that begin immediately with user consent

  • downloadable or activated software

  • custom ECU tuning files

By purchasing, the user expressly agrees to immediate execution and acknowledges the loss of the right of withdrawal.

9. Delivery & Updates

Delivery is performed electronically.
Software updates may be provided at the Company’s discretion.
The Company is not obligated to provide ongoing updates or support unless agreed in writing.

10. No Warranty & Assumption of Risk

All services and software are provided “as is”.

The Company makes no warranties, express or implied, including:

  • performance results

  • compatibility with specific vehicles or systems

  • uninterrupted or error-free operation

Use of ECU tuning and automotive software involves inherent risk, which the user fully accepts.

11. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for:

  • engine, ECU, or drivetrain damage

  • software malfunction or incompatibility

  • data loss

  • vehicle downtime or financial loss

  • regulatory penalties or inspection failures

Total liability is limited to the amount paid for the specific product or service.

12. Intellectual Property

All ECU files, tuning methods, software, and website content remain the intellectual property of the Company.
Unauthorized copying, sharing, resale, or distribution is prohibited.

13. Refund Policy

Refunds are governed exclusively by our Refund Policy, which forms an integral part of these Terms.

14. Service Refusal & Termination

The Company reserves the right to:

  • refuse service or software access without obligation to justify

  • suspend or terminate accounts for violations of these Terms

  • block users abusing payment or dispute systems

15. Data Protection

Personal data and uploaded files are processed in accordance with our Privacy Policy.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Croatia.
Jurisdiction lies with the competent court in Zadar, Croatia, unless mandatory consumer protection laws apply.
